These Terms & Conditions (“Terms”) apply to donations made to and fundraising campaigns conducted by the Olivia Newton‑John Cancer Research Institute (“ONJCRI”, “we”, “us”, “our”), including:

that we operate or authorise (“Fundraising Activity” or “Fundraising Activities”).
By participating in, registering for or donating to any Fundraising Activity, you agree to these Terms and our Privacy Policy (together, the “Agreements”). In these Terms, “you”, “participant” or “donor” means an individual or organisation participating in, registering for or donating to a Fundraising Activity.

2) Scope and acceptance
These Terms govern your participation in Fundraising Activities run by or on behalf of ONJCRI, including activities branded under specific campaigns such as the Imagine Appeal.
Where a campaign has additional rules (e.g., challenge rules, prize draw terms), those rules (“Campaign‑Specific Terms”) apply in addition to these Terms. If there is a conflict or inconsistency between the Campaign‑Specific Terms and these Terms, the Campaign‑Specific Terms take precedence for that campaign, to the extent of any inconsistency.
If you create a supporter‑led activity using our official tools such as a peer‑to‑peer fundraising page, you must also comply with any guidelines we provide.
3) Fundraising Activities conducted on behalf of ONJCRI
Where required by law (or upon your request) that you obtain authorisation to conduct Fundraising Activities on behalf of ONJCRI, ONJCRI will issue you with an ‘Authority to Fundraise’ confirming the terms of such authority and subject to any conditions specified within it. ONJCRI reserves the right to refuse, place conditions on or withdraw an Authority to Fundraise at any time, by notice to you.
Where an Authority to Fundraise is issued, you must not represent that you are an agent or employee of ONJCRI.
4) Eligibility and conduct
Participants must be 18 years or over to:
- register;
- donate in their own name;
- create a fundraising page; or
- participate in any Fundraising Activities.
If you are under 18, a parent or guardian must register on your behalf and supervise your participation.
All Fundraising Activities must be carried out safely, lawfully and respectfully, and must not damage or be likely to damage, ONJCRI’s reputation.
You must comply with all applicable laws (including but not limited to local council requirements, venue permits, food handling rules, alcohol licensing and any state/territory charitable fundraising regulations).
5) Registrations, tickets and merchandise
If your participation involves registration fees, tickets or merchandise, these will only be confirmed once payment is received.
We may apply capacity limits, cut‑off dates or eligibility criteria requirements.
Event details (such as date, time, location, route, format) may change or be cancelled due to circumstances outside of our control (e.g., safety, weather, venue issues). If this occurs, we will endeavour to provide timely notice and, where appropriate, offer options such as transfer, credit or converting your payment to a donation.
6) Donations, payment processing and currency
Donations may be processed by ONJCRI or via approved third‑party payment processors. By donating, you authorise the relevant processor to charge your selected payment method and acknowledge that the relevant platform’s terms of service and privacy policy apply to your transaction.
ONJCRI is not responsible for processing failures, outages or security incidents attributable to third-party payment processors, but will take reasonable steps to assist affected donors.
All amounts are in Australian Dollars (“AUD”) unless stated otherwise.
You are responsible for any bank fees, exchange costs or card surcharges.
If you set up a recurring donation, it will continue until you cancel it with reasonable notice (see Section 10).
7) Tax receipts and DGR status
ONJCRI holds Deductible Gift Recipient (“DGR1”) status as endorsed by the Australian Taxation Office. Donations of $2 or more to ONJCRI may be tax-deductible to the extent permitted by Australian tax law, provided no material benefit is received in return. Tax-deductibility is assessed at the time of the donation based on ONJCRI’s current endorsements and applicable law. Where eligible, we will issue official receipts to the name and email you provide. Please keep your receipt for your records and seek independent tax advice if needed.
For ticketed events, auctions, raffles or merchandise, some or all of the payment may not be tax‑deductible. Where a payment is only partly tax-deductible, we will specify the deductible portion on your receipt.
8) Refunds and errors
Donations are generally non‑refundable. However, if you believe a donation was made in error or without authorisation, such as a duplicate payment, an incorrect amount or a technical processing issue, please contact us promptly with your donation details and supporting information. We will review refund requests made within 30 days of the donation. Any refund provided will be returned to the original payment method, where possible.
Ticket and registration refunds are subject to the campaign or event‑specific terms and your statutory rights under the Australian Consumer Law (“ACL”). Chargebacks may result in cancellation of any associated benefits (e.g., entries, tickets or rewards).
9) Raffles, prize draws, challenges and incentives
Raffles, lotteries, games of chance/skill and prize draws are conducted in accordance with applicable permits and state/territory laws. Campaign‑Specific Terms will specify eligibility, method of entry, opening/closing dates, winner selection, notification and prize details.
Where challenges or incentives (e.g., matched giving, leaderboards, rewards) are offered, ONJCRI may verify fairness, adjust rules for integrity or modify/withdraw incentives where necessary to prevent misuse or error.
Prizes are not transferable, exchangeable or redeemable for cash unless required by law.
10) Recurring donations and cancellation
You may cancel a recurring donation at any time by contacting us at philanthropy@onjcri.org.au or using self‑serve options where available. Please allow up to 10 business days for processing. Donations that are charged before your notice of cancellation takes effect are non-refundable. If a scheduled payment processes during the cancellation window, ONJCRI will use reasonable efforts to issue a refund on request, but is not required to issue one where the payment was processed in good faith.
ONJCRI may suspend or cancel a recurring donation if we cannot process a payment or if we suspect unauthorised use or misuse.
11) Peer‑to‑peer and supporter‑led fundraising
If you create a personal or team fundraising campaign for Fundraising Activities, you must:
- accurately represent the purpose of the fundraising and not mislead donors or the public;
- promptly remit funds to ONJCRI via the approved platform or method;
- obtain any permissions needed for venues, raffles, collections or public activities;
- not use ONJCRI’s name, logo or images in a way that implies endorsement of third‑party products/services without our prior written approval. This restriction applies equally to the use of other ONJCRI creative assets, for example the Imagine Appeal brand.
ONJCRI may edit, moderate or request removal of pages/content that violate these Terms or applicable laws. Where a supporter-led page is found to be in breach, ONJCRI reserves the right to close the page, redirect or withhold funds pending investigation and seek recovery of any losses or reputational damage suffered, including under the indemnity in Section 21 below.
12) Third‑party platforms and services
Some Fundraising Activities use third‑party platforms, such as payment gateways, ticketing or peer-to-peer fundraising. The terms and privacy policies of those platforms apply between you and the relevant third-party, in addition to these Terms and our Privacy Policy.
To the extent permitted by law, ONJCRI is not responsible for any such third-party platforms, including any downtime, service failures, errors, loss or data incidents caused by third‑party providers. We take reasonable care in selecting reputable platforms, but we cannot guarantee their performance.
13) Privacy, data and communications
We handle your personal information in accordance with our Privacy Policy which explains how we collect, use, store and disclose your personal information and your rights to access and correct it.
By providing your details, you consent to operational communications about your participation and any donations you make. You can opt out of marketing communications at any time via the methods described in our Privacy Policy.
If you upload or submit any materials for the purposes of Fundraising Activities, including comments, photos, images or stories (“Content”), you confirm you have obtained all necessary rights, permissions and consents to provide the Content.
On submission, you grant ONJCRI a non‑exclusive, worldwide, royalty‑free licence to use, reproduce, modify, adapt, publish and display the Content for ONJCRI’s charitable purposes and communications (including fundraising campaigns, annual reports, grant applications, donor relations and public advocacy) without compensation, restriction on use or attribution. Whilst you grant ONJCRI the licence set out above, if the Content you have submitted is proposed to be used for public-facing communications purposes (such as marketing, media or public-facing materials), we will provide you with prior notice and obtain your consent before using the Content for those purposes.
To the extent permitted by law, you consent to any act or omission by ONJCRI in exercising the rights you grant under these Terms that would otherwise infringe your moral rights in the Content (including any failure to attribute you, where reasonably practicable).
You warrant that you have full authority to grant these rights and consents.
14) Intellectual property and content rules
All ONJCRI brand names, sub-brands, logos, designs and any other materials or content owned or controlled by ONJCRI are protected by intellectual property laws. You must not use them without prior written permission, except as expressly permitted for supporter pages and assets we provide for Fundraising Activities.
You must not upload content that is unlawful, defamatory, infringing, hateful, harassing or that violates privacy or third‑party rights. We may remove such content and/or restrict participation.
15) Health, safety and risk
You understand that participation in events, challenges or activities is voluntary and at your own risk. It is your responsibility to consider your health status and obtain medical advice if needed and follow all safety guidance from organisers, venues and authorities. Parents/guardians are responsible for supervising minors.
You understand that ONJCRI does not provide personal accident or public liability insurance (or any other insurance) for the participation in Fundraising Activities. ONJCRI does not accept responsibility for any claims arising out of events, challenges or activities as conducted by external fundraisers.
16) Financial transparency and use of funds
Unless stated otherwise, funds raised will be applied to ONJCRI’s charitable purposes, including priority research needs, programs and related operational support including administration costs.
Where a campaign invites donations to a specific research area or initiative, we will endeavour to honour donor intent; however, if circumstances change or a project is fully funded, ONJCRI may apply funds to the nearest related purpose.
17) The Imagine Appeal — campaign‑specific note
The Imagine Appeal is a flagship fundraising initiative of ONJCRI to accelerate patient‑centred cancer research and translational impact.
All donations made to the Imagine Appeal are received and managed by ONJCRI (or appointed processors) and are governed by these Terms. ONJCRI remains the accountable legal entity for Fundraising Activities conducted under any campaign-specific branding or microsite operated on or on behalf of ONJCRI (including the Imagine Appeal).
From time to time, the Imagine Appeal may include time bound campaigns, matched giving opportunities, donor recognition or events with additional rules published on the relevant campaign page. Those rules form part of these Terms.
18) Corporate partners, workplaces and matched giving
Corporate or workplace Fundraising Activities that use the ONJCRI name, logo or other intellectual property must be approved by ONJCRI in advance, unless the Fundraising Activities are run through the Good2Give third-party platform.
Matched giving is only available when a matching funder has formally agreed to provide matching funds for a specific campaign or event. Matched giving is subject to the Campaign‑Specific Terms (e.g., caps, time windows, eligible payments). The relevant Campaign‑Specific Terms will be outlined on the relevant campaign page.
Matched giving does not apply to donations made outside the published matching period or donations that fall outside the eligibility criteria of the Campaign‑Specific Terms, for example donations made after the matching cap has been reached. Where a donation does not qualify, it will still be received by ONJCRI but will not be matched.
19) Anti‑fraud, misuse and sanctions
We may suspend or terminate participation, withhold benefits or decline donations where we suspect fraud, unauthorised payments, misuse or breach of these Terms or applicable laws. ONJCRI may report suspected fraud or financial crime to relevant authorities, including the Australian Federal Police.
We may be unable to accept funds from certain persons or jurisdictions due to sanctions, obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) or other compliance obligations.
20) Liability
Except for any liability that cannot by law be excluded, ONJCRI and our respective officers, employees, volunteers, agents and representatives are not liable for any personal injury, damages, expenses or loss, including indirect or consequential loss, loss of data or loss arising from events outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies any non‑excludable rights or remedies you may have under the ACL.
21) Indemnity
You agree to indemnify ONJCRI from claims, losses, damages, costs or expenses arising from any material breach by you of these Terms, your unlawful conduct or your negligence in connection with a Fundraising Activity.
22) Changes to campaigns and these Terms
From time to time, we may update these Terms or campaign details to reflect operational, legal or safety requirements. Changes take effect when posted on our website and/or the relevant campaign site (as applicable).
By continuing to participate in Fundraising Activities after an updated version of these Terms has been made available, you agree to the updated terms.
23) Governing law and jurisdiction
These Terms are governed by the laws of Victoria, Australia. You submit to the non‑exclusive jurisdiction of the courts of Melbourne, Victoria Australia.
